§ 1 Scope
These Terms of Use apply to the PenVita app of ICR Parkett GmbH, Sommerstr. 27 A, 92421 Schwandorf, Germany.
§ 2 Right of use
With the purchase, the user acquires a non-exclusive, non-transferable right to use the app on their own devices.
§ 3 Trial period (Reverse Trial)
14 active days of use free of charge with full access. After that, a one-time purchase is required. Without purchase: read-only mode (all data is preserved). One-time 7-day extension possible.
§ 4 Not a medical device
PenVita is expressly not a medical device, not a digital therapeutic and not medical software according to MDR (EU) 2017/745, and has not been cleared or approved by the U.S. FDA.
Medical decisions — in particular regarding the dosing of GLP-1 medications — must only be made with a doctor. In medical emergencies, call your local emergency number (EU: 112, UK: 999, US/CA: 911, AU: 000).
§ 5 Anonymous data use
Voluntary consent for anonymous data use for research purposes and sharing with partners. PenVita may earn revenue from this. Revocation possible at any time.
§ 6 Disclaimer
To the extent permitted by applicable law, no liability for:
• Medical decisions based on the app
• Data loss due to device failure
• Erroneous analyses or calculations
Liability for gross negligence, intent, and damages arising from injury to life, body or health remains unaffected. Mandatory consumer protection rights under your local law remain unaffected.
§ 7 Trademarks
PenVita is a trademark of ICR Parkett GmbH. All product names mentioned in the app (Mounjaro®, Wegovy®, etc.) are trademarks of their respective owners and are used solely for product identification under applicable trademark fair-use principles (e.g. § 23 German Trademark Act, nominative fair use under U.S. law, Art. 14 EU Trademark Regulation).
§ 8 Updates
Before each major update, data is automatically backed up. Price adjustments are possible at any time and will be communicated via the App Store / Play Store before taking effect.
§ 9 Applicable law & place of jurisdiction
German law applies, excluding the UN Sales Convention. Place of jurisdiction for merchants: Schwandorf, Germany. For consumers, mandatory consumer protection rules of the consumer's country of residence remain unaffected.
